Woggi.com could also pursue violators with claims that they have violated various criminal and/or civil laws as applied by the relevant jurisdiction. Woggi.com will cooperate with any investigation by any Federal, State, or local body or any court or tribunal legitimately exercising its rights. Such cooperation may be without notice to You. If Woggi.com believes in its sole discretion that any user content or involvement with the site may create liability for Woggi.com , Woggi.com may take any actions that it believes are prudent or necessary to minimize or eliminate its potential liability, including but not limited to, the release of User information. This Agreement is the complete and exclusive agreement between the parties with respect to the subject matter hereof, superseding any prior agreements and or communications regarding such subject matter. This Agreement may only be modified, or any rights under it waived, by a written document executed by both parties.
These Terms of Participation and the relationship between User and Woggi.com shall be governed by the laws of the State of Florida without regard to its conflict of law provisions. User and Woggi.com agree to submit to the personal and exclusive jurisdiction of the courts located within the county of Sarasota, Florida.
The failure of Woggi.com to exercise or enforce any right or provision of these Terms of Participation shall not constitute a waiver of such right or provision. If any provision of these Terms of Participation is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties’ intentions as reflected in the provision, and the other provisions of these Terms of Participation shall remain in full force and effect.
User agrees that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Service or the Terms of Participation must be filed within six (6) months after such claim or cause of action arose or be forever barred.
Membership (Option TBD)
If/when Woggi offers a membership option; in order to become a member and enjoy the Services (TBD), you must read and accept the terms and conditions of this agreement and our Privacy Policy. Woggi does not sell products to anyone under the age of 21. If you do not meet the minimum age requirement, please do not enter our site.
MEMBERSHIP AGREEMENT BETWEEN Woggi AND USERS
You acknowledge and agree that by using Woggi, you are entering into a legally binding agreement (the “Agreement”) with Woggi Located at 4801 S Tamiami Trl Ste 3 Sarasota, FL 34231 (the “Company”, “we”, “our”, or “us”), and that by becoming a “User”, “Member” or “Viewer”, you acknowledge that you have read and understood these terms and conditions and that you agree to be bound by all aspects of this Agreement (both in letter and in spirit) and held responsible for any violations thereof. By accepting the terms of this Agreement, you also verify that you have read and understand our Privacy Policy. This statement supersedes any prior agreements (both oral or written). If any section of these terms is found to be unenforceable either in law or in practice, the rest of the agreement in its entirety will remain in effect. Additionally, the unenforceable provision will be modified so as to render it enforceable and effective to the maximum extent possible in order to affect the intention of the provision. The Company’s failure to act to enforce the Agreement does not constitute a wavier of said Agreement.
If you are using the Site as a representative for another company, that organization may have a separate agreement with us. However, as an individual user you are bound by this Agreement regardless of any other agreements entered into by the Company.
